Cyber Services, Inc. Acceptable Use Policy

As an ISP, Cyber Services (CSI) primary responsibility is to provide access to the Internet for our clients. CSI seeks to do so with the least amount of intrusion and interference possible. This Acceptable Use Policy is a tool that enables us to protect our clients and continue to provide a fast, highly available network to them. Violation of this policy can result in immediate termination of your CSI account. Access to Cyber Services, Inc.'s Internet Service is provided subject to the following terms and conditions:

Warranties/Disclaimers

CSI Internet service is provided on an "as is, as available" basis. No warranties, express or implied, including, but not limited to, those of merchantability or fitness for a particular purpose, are made with respect to CSI or any information or software therein. You release CSI from and CSI shall have no liability or responsibility for any direct, indirect, incidental, or consequential damages suffered by you in connection with your use of or inability to use the CSI services including, but not limited to, damages from loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions, or due to inadvertent release or disclosure of information sent by you even if the same is caused by CSI's own negligence. Without limiting the generality of the foregoing, CSI disclaims to the full extent permitted by applicable law any responsibility for (and under no circumstances shall be liable for) any conduct, content, goods, and services available on or through the Internet or the CSI services. In no event shall CSI's aggregate liability exceed the amount paid by you to CSI for the CSI services. Use of any information obtained via CSI's Internet service is at the user's own risk. CSI specifically disclaims any responsibility for the accuracy or quality of information obtained through its services.

Nontransferability of Account

CSI accounts are non-transferable.

Unacceptable Conduct

PPP dial-up Internet access provided by Cyber Services, Inc. may only be used for lawful purposes. Transmission of any material in violation of any U.S. or state regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. You agree to indemnify and hold harmless Cyber Services, Inc. from any claims resulting from your use of the service which damages you or another party.

Cyber Services does not allow the sending of unsolicited e-mail and unsolicited bulk e-mail (spam). We reserve the right to terminate accounts at our discretion following reports of spamming.

Right to Disconnect

Cyber Services reserves the right to terminate accounts immediately for violating the acceptable use policy. We also reserve the right to disconnect service for non-payment. Accounts are in default if payment is not received within 30 days after the first of each billing month. If your payment is returned to us unpaid you are immediately in default and subject to a returned check charge of $25.00 from Cyber Services. Accounts unpaid after 60 days may have their service interrupted. Such interruption does not relieve your obligation to pay the monthly charge. Accounts in default are subject to an interest charge of 1.5% per month on the outstanding balance

Nondedicated Accounts

CSI dial-up accounts are non-dedicated. We do not provide static IP addresses for non-dedicated accounts.

Compliance with Rules of Other Networks

CSI strives to be a good net-citizen. To this end, we work cooperatively with other ISPs and network providers. When possible we will comply with other networks as they enforce their rules.

Monitoring and Privacy

CSI respects its users privacy. We monitor accounts to achieve network performance goals and to comply with legal requirements.

Cooperation with Authorities

CSI cooperates fully with legal authorities.

ISP's Right to Suspend or Cancel Accounts

We reserve the right to suspend or cancel accounts.

Rights to Damages

CSI service is supplied on an "as is, as needed" basis. By accepting service, you waive the right to damages from use of this service.

Right to Modify or Change Service

Contracts automatically renew for contract length unit. Only a written request to terminate your service relieves you of your obligation to pay the unit account charge. Prices are subject to change without notice. Existing customers will receive 30 days notice of changes in price.
